Welcome to Anatolvia (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, marketplace, and related services (collectively, the “Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use Anatolvia.

1) Overview

Anatolvia is a multi-vendor marketplace connecting customers with independent vendors and service providers. We facilitate listings, communication, and payments between users but do not manufacture, own, rent, or sell any items or services.

Important: Anatolvia acts solely as an intermediary platform and is not a party to any sale, rental, or service contract made between users.

2) Accounts & Eligibility

  • You must be 18 years or older to register and use the Platform.
  • You are responsible for safeguarding your credentials and all activity under your account.
  • We may suspend or terminate accounts that violate these Terms, applicable laws, or create risk for the Platform or its users.

3) Vendor Responsibilities

  • Vendors are independent entities solely responsible for listings, pricing, stock, services, fulfillment, customer communications, and tax reporting.
  • Vendors must comply with all consumer protection, safety, labeling, licensing, advertising, and tax obligations.
  • Prohibited or illegal content (counterfeit, unsafe, or restricted items/services) is strictly forbidden.
  • Vendors may publish their own refund, cancellation, or rental policies; these override Anatolvia’s default policy for that store.
  • Vendors agree to indemnify and hold Anatolvia harmless for claims or losses arising from their listings, conduct, or transactions.

4) Customer Responsibilities

  • Review product/service descriptions, vendor policies, delivery terms, and prices before ordering or booking.
  • By completing a transaction, you accept the vendor’s terms and acknowledge Anatolvia acts only as a platform.
  • Do not misuse the Platform, submit fraudulent claims, or harass vendors or other users.
  • Rental customers are responsible for proper use, timely return, and condition of rented items.

5) Payments, Commissions & Taxes 10% Commission

5.1 Commission & Marketplace Fee

Anatolvia charges a 10% commission (Marketplace Fee) on every completed transaction through the Platform, including sales, services, and rentals. This fee is automatically deducted before funds are released to the vendor and is non-refundable. It covers platform infrastructure, payment processing, support, and fraud protection.

5.2 Payment Processing

  • Payments are handled by secure third-party processors (e.g., Stripe Connect, PayPal Commerce, iyzico Marketplace). Anatolvia does not store full card data.
  • Funds may be temporarily held until transaction confirmation; after confirmation Anatolvia deducts its commission and releases the balance to the vendor.
  • Anatolvia is not a financial institution or money transmitter and bears no fiduciary duty beyond routing payments via regulated partners.

5.3 Taxes

  • Taxes, duties, or fees may be charged based on jurisdiction. Vendors are solely responsible for tax reporting and remittance; Anatolvia is not the seller of record.

6) Refunds, Returns, Cancellations & Disputes

  • Vendor policies govern. If a vendor has no policy, Anatolvia’s default policy applies.
  • Approved refunds are typically issued to the original payment method within 5–10 business days after inspection or confirmation.
  • In rentals, vendors manage damage claims, deposits, and late returns.
  • Anatolvia may, at its discretion, assist in communications but has no obligation to mediate or refund.

7) Risk, Damages & Insurance

  • All transactions are at the user’s own risk. Anatolvia does not insure or guarantee any product, rental, or service.
  • Vendors should maintain appropriate product liability or rental insurance where required.
  • Customers are responsible for any damage, loss, or theft of rental items.
  • Anatolvia is not liable for consequential or punitive damages.

8) Content & Intellectual Property

  • Platform code, UI, graphics, and branding are owned by or licensed to Anatolvia.
  • Vendors retain ownership of listings and media but grant Anatolvia a non-exclusive, worldwide, royalty-free license to host, display, promote, and distribute such content for Platform operations and marketing.
  • Users may not copy, modify, or distribute Platform content without written permission.

9) Reviews & User Content

  • Reviews must reflect genuine experiences; no false, defamatory, or misleading content.
  • We may remove or moderate content that violates these Terms, community standards, or applicable law.

10) Privacy

Your use of the Platform is governed by our Privacy Policy and Cookie Policy, which explain our data practices and use of cookies or similar technologies.

11) Platform Availability & Technical Disclaimer

We strive for uninterrupted service but cannot guarantee continuous access. Maintenance, updates, or third-party outages may cause delays. We are not responsible for losses from downtime, network failures, or third-party integrations (e.g., maps, payment gateways).

12) Third-Party Services & Links

The Platform may link to or integrate with third-party services. Anatolvia does not control or endorse those providers and assumes no responsibility for their content, policies, or actions.

13) Disclaimers & Limitation of Liability

  • The Platform and services are provided “as is” and “as available.”
  • Anatolvia is a facilitating platform and payment intermediary, not responsible for vendor actions, product/service defects, delays, cancellations, or rental damages.
  • Liability Cap: To the maximum extent permitted by law, Anatolvia’s total aggregate liability shall not exceed the greater of (a) USD $100 or (b) the total fees you paid to Anatolvia in the three (3) months preceding the claim.
  • No Consequential Damages: Anatolvia is not liable for lost profits, business interruption, or data loss.

14) Indemnification

You agree to indemnify, defend, and hold harmless Anatolvia and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from (i) your use or misuse of the Platform; (ii) your breach of these Terms or applicable law; or (iii) your dispute with another user or vendor.

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Anatolvia is registered and operates, without regard to conflict-of-law rules. Parties shall first attempt good-faith negotiations. If unresolved, disputes shall be submitted to the competent courts of that jurisdiction, unless mandatory consumer laws require otherwise.

16) Force Majeure

Anatolvia shall not be liable for delay or failure due to events beyond reasonable control, including natural disasters, internet outages, government actions, labor disputes, or cyberattacks.

17) Termination

We may suspend or terminate any account that violates these Terms, misuses the Platform, or threatens its integrity. You may close your account at any time, subject to completion of any pending orders, payments, or obligations.

18) Modification of Terms

We may amend these Terms from time to time. Updated versions take effect upon posting. Continued use constitutes acceptance of the revised Terms.

19) Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
